Judge Rules in Favor of Trump on PA Voter ID Deadline

President Donald Trump just attained a major victory in a Pennsylvania court.

A judge ruled that the PA Secretary of State lacked authority to alter the deadline for mail-in ballots where the voter hadn’t provided proof of identification just 2 days before election day.

Secretary of State Kathy Boockvar had previously provided guidance saying that proof of identification could be provided up to November 12th, even though State law only permits voters to have until 6 days after the election.

A Pennsylvania judge ruled in favor of the Trump campaign Thursday, ordering that the state may not count ballots where the voters needed to provide proof of identification and failed to do so by Nov. 9.

State law said that voters have until six days after the election — this year that was Nov. 9 — to cure problems regarding a lack of proof of identification. After the Pennsylvania Supreme Court ruled that mail-in ballots could be accepted three days after Election Day, Pennsylvania Secretary of State Kathy Boockvar submitted guidance that said proof of identification could be provided up until Nov. 12, which is six days from the ballot acceptance deadline. That guidance was issued two days before Election Day.

“[T]he Court concludes that Respondent Kathy Boockvar, in her official capacity as Secretary of the Commonwealth, lacked statutory authority to issue the November 1, 2020, guidance to Respondents County Boards of Elections insofar as that guidance purported to change the deadline … for certain electors to verify proof of identification,” Judge Mary Hannah Leavitt said in a court order.

This was in line with the Trump campaign’s argument, which was that there was no basis in the state’s law to extend the identification deadline, and that Boockvar did not have the power to unilaterally change it.

Democrats are still falsely claiming that their is no widespread voter fraud, despite continuous evidence to the contrary.

Conservatives on Twitter celebrated this small victory.

This fight is far from over though.

The Pittsburgh Post-Gazette has more on the judges ruling:

Ms. Boockvar argued to the court that the guidance came from a provision in the commonwealth’s election code that allows voters to prove their identities “within six calendar days following the election.” Because the Pennsylvania Supreme Court extended the ballot deadline to Nov. 6, then the deadline for voters to confirm their ID would also be extended.

But the Trump campaign disagreed. “If the deadline is calculated as the statute is written, then as it pertains to the November 3, 2020 General Election, this deadline for voters to resolve proof of identification issues is Monday, November 9, 2020, not November 12, 2020,” the campaign wrote in a filing. They also said Ms. Boockvar lacked the authority to give such guidance.

Judge Leavitt sided with the Trump campaign on that argument. In a footnote, she said Ms. Boockvar’s position would have been achievable if there was an amendment to the Pennsylvania Supreme Court’s order extending the ballot deadline.
