The Arizona Court of Appeals has ordered a conference on February 1st to reconsider Kari Lake’s lawsuit alleging the 2022 midterm election was botched.
A three-judge bench previously scheduled on January 24th a conference and oral argument in Kari Lake’s appeal against Maricopa County Superior Court Judge Peter Thompson’s dismissal of her lawsuit to challenge the 2022 midterm election results.
However, the court issued a new order setting a conference date and agreeing to consider Lake’s ‘Petition for Special Action.’

In an order issued on January 9th, the court ruled “resetting this matter for conference on 2/1/23.”

The court ruled that lawyers for Katie Hobbs, who was recently sworn in as governor, have until January 17th to argue why Lake’s lawsuit should be rejected.

Lawyers for Democrat Arizona Gov. Katie Hobbs, the state’s former secretary of state, has until Jan. 17 to respond and argue why Lake’s challenge should be rejected, according to the order. Lake had petitioned both the state’s Appeals Court and Supreme Court after a Maricopa County judge rejected her case after a two-day trial in December.
But earlier this month, the Arizona Supreme Court denied Lake’s petition to transfer her election lawsuit to the high court and said it will be heard before the Appeals Court first.
In December, Lake filed a lawsuit against Hobbs in her capacity as secretary of state, Maricopa County supervisors, Maricopa Recorder Stephen Richer, and other officials, asserting that the county’s handling of the election was seriously flawed and disenfranchised Election Day voters. Lake, a former broadcast journalist, argued that such disenfranchisement and election voting issues were enough to swing the election in her favor. She lost by 17,000 votes.
A Maricopa County judge, Peter Thompson, threw out Lake’s lawsuit on Dec. 24 and said she did not produce enough evidence, but he ruled that Lake should not be sanctioned and fined hundreds of thousands of dollars. Days before that, Thompson tossed out 8 of Lake’s 10 election claims.

Meanwhile, Maricopa County officials last week announced an investigation into problems that occurred during the 2022 midterm election.

Former Arizona Supreme Court Justice Ruth McGregor agreed to lead the “independent” endeavor, county officials said in a statement. McGregor was a member of the state Supreme Court from 1998 to 2009 and participated in a 2019 investigation into security issues at Arizona’s prisons.
McGregor will hire a team of “independent experts to find out why the printers that read ballots well in the August Primary had trouble reading some ballots while using the same settings in the November General,” Maricopa Board of Supervisors Chairman Bill Gates and Vice Chairman Clint Hickman said in their statement. “Our voters deserve nothing less.”
