A Democratic Township Commissioner has just been arrested for allegedly raping a 15-year-old boy in 2017.
Philadelphia Police Department spokesperson Eric McLaurin announced on Friday that 50-year-old Darby Township Commissioner Marvin Smith has been charged with rape, sexual assault and for luring a child into a motor vehicle.
Smith has turned himself in and is now already out on a $100,000 bond.
As of right now Smith is still Darby’s Town Commissioner and has yet to resign or have been removed by Pennsylvania’s Governor.

Darby Township Commissioner Marvin E. Smith has been charged with rape and related offenses for allegedly luring a teenage boy into his vehicle and sexually assaulting him in 2017.
Smith, 50, is charged with 10 counts including rape by forcible compulsion, involuntary deviate sexual intercourse by forcible compulsion, sexual assault, statutory sexual assault, indecent assault, luring a child into a motor vehicle, corruption of a minor and reckless endangerment, according to online court records.
Neither Smith nor Darby Township Board of Commissioners President Robert Gougler responded to requests for comment Friday.
Members of the Philadelphia Police Department’s public relations department were not available Friday, but prior news reports by the Philadelphia Inquirer and ABC6 indicate the assault occurred in August 2017, when Smith allegedly approached the 15-year-old boy in West Philadelphia and convinced him to enter the vehicle by claiming he was a family friend.
Smith, a Democrat who was elected to represent Darby Township’s First Ward in 2019, allegedly then took the teen to Cobbs Creek Park on the 200 block of South 63rd Street, where he exposed himself and sexually assaulted the boy, according to ABC6. Smith then allegedly dropped the victim off at an undisclosed location.
The teen reported the alleged assault to Philadelphia Police in 2019, but an arrest warrant was not issued until Nov. 22, 2021, according to news reports. Smith turned himself in to the Special Victims Unit Tuesday and was released after posting 10% of $100,000 bail.

Smith turned himself in Tuesday. A warrant had been issued for his arrest on Nov. 22. Court documents show Smith posted his $100,000 bail on Wednesday and was released pending his next court date scheduled for Jan. 5
In April 2019, the boy told Philadelphia police he had been sexually assaulted by Smith on Aug. 12, 2017, McLaurin said. The alleged victim was 15 at the time of the incident.
He told investigators he was approached by Smith in a vehicle. The commissioner identified himself as a family friend and offered to give the boy a ride home.
But instead Smith drove to a park near 200 S. 63rd St. where he allegedly exposed himself to the boy before sexually assaulting him. Then Smith dropped the teen off at an undisclosed location and drove away.
