MORE WINNING: The 9th Circuit Gives President Trump TWO Big Wins On Sanctuary Cities and Planned Parenthood!

President Trump must be feeling REAL good today.

The infamously left-leaning (although less so than it used to be after Trump’s recent appointments) just handed our President two big wins on two hot button issues:  Sanctuary Cities and Abortion.

And guess what?

Turns out President Trump and his Administration was proven right on both!

First up, a big win on Sanctuary Cities:

The Hill explained more details:

The 9th Circuit Court of Appeals on Friday ruled in favor of the Trump administration's efforts to prioritize federal dollars for local policing to towns and cities that complied with certain immigration policies. 

The ruling, a split 2-1 decision, said the Department of Justice (DOJ) was within its rights to withhold Community Oriented Policing Services (COPS) grants from sanctuary cities and states over their refusal to work with federal immigration enforcement authorities and instead prioritize agencies that focused on unauthorized immigration and agreed to give Immigration and Customs Enforcement (ICE) access to jail records and immigrants in custody. 

The city of Los Angeles first sued the administration after it was denied a $3 million grant on the grounds that it did not receive the money because it did not focus on immigration for its community policing grant application. The decision reversed a district court’s ruling.

“The panel rejected Los Angeles’s argument that DOJ’s practice of giving additional consideration to applicants that choose to further the two specified federal goals violated the Constitution’s Spending Clause,” wrote Judge Sandra Ikuta, joined by Judge Jay Bybee. 

“The panel held that DOJ did not exceed its statutory authority in awarding bonus points to applicants that selected the illegal immigration focus area or that agreed to the Certification,” she wrote.

Judge Kim Wardlaw wrote in dissent that the Justice Department’s efforts to prioritize immigration in determining the awarding of COPS grants was “Orwellian” and said the majority’s ruling goes “astray.” 

“The majority goes astray by finding no meaning in Congress’s use of the term ‘community-oriented policing’ and then deferring under Chevron to DOJ’s Orwellian effort to define ‘community-oriented policing’ to include 'partnering with federal law enforcement to address illegal immigration,' ” she wrote.

“Congress did not authorize COPS grants for anything other than placing additional state and local cops on the beat and promote community partnerships,” she wrote.

Congress created the fund in 1994 to provide federal assistance to state and local law enforcement to get more cops on beats and improve police-community interaction. It allowed the Justice Department to administer the funds.

President Trump has repeatedly railed against sanctuary cities as he touts his hard-line immigration stances.

Then we move to win #2, a win on abortion and AGAINST Planned Parenthood!

In a 7-4 decision, the 9th Circuit Federal Appeals Court ruled Thursday in favor of allowing the Trump Administration to enforce the Title X rule banning taxpayer monies for facilities that perform or refer for abortions.  

The "Protect Life" rule stipulates that family planning and other government-funded services cannot be housed in the same facility where abortions are performed.  In its decision, the court rejected efforts by abortion supporters to stop the rule from going into effect while the merits of the case are litigated in other courts.

Title X funds are supposed to be used for family planning, cancer screenings, testing for sexually transmitted diseases, and other services, particularly for low-income patients. The "Protect Life" rule forbids grant recipients from using the funds to "perform, promote, refer to, or support abortion as a method of family planning."  

In a statement, Democrat Speaker of the House Nancy Pelosi blasted the ruling, "The Trump Administration's gag rule perfectly showcases their utter disdain for women's health and women's rights. This misguided ruling paves the way for politicians to deny women access to the basic preventive and primary health care that is their right..."

Planned Parenthood is the nation's largest abortion provider and stands to lose as much as $60 million per year with this new rule, a fraction of the half billion it gets annually in federal funds. 

Planned Parenthood CEO Leana Wen called the ruling "devastating news for the millions of people who rely on Title X" and vowed her organization would continue its efforts to block "this dangerous rule," which she says "allows the government to censor our doctors and nurses from doing their jobs."

National Right to Life President Carol Tobias cheered the decision, "Abortion is not family planning. This rule draws a bright line between family planning and abortion."

Kristan Hawkins, president of Students for Life of America, took direct aim at Planned Parenthood, telling the Washington Times, "The Protect Life rule ensures that the people helping women plan for families are not misusing appointments to market abortions at taxpayer expense. Title X had become a marketing slush fund for Planned Parenthood, and the Trump Administration and the American people won" with this decision.
