“Abolish the ATF Act” Introduced in Congress

Rep. Matt Gaetz on Wednesday introduced the “Abolish the ATF Act.”

The legislation stems from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) enacting a rule that would make pistol-stabilizing braces illegal for individuals without a particular license.

The ATF had previously ruled that pistol braces were legal, but a new rule was sought by President Joe Biden as part of his promise to reform gun laws.

The 296-page document outlines several options that gun owners with stabilizing braces have to avoid prosecution.

“Any weapons with ‘stabilizing braces’ or similar attachments that constitute rifles under the NFA must be registered no later than 120 days after date of publication in the Federal Register,” read the rule, “or the short barrel removed and a 16-inch or longer rifle barrel attached to the firearm; or permanently remove and dispose of, or alter, the ‘stabilizing brace’ such that it cannot be reattached; or the firearm is turned in to your local ATF office. Or the firearm is destroyed.”

Gaetz said the House GOP has the ATF in their “crosshairs.”

“House Republicans have the ATF in our crosshairs. The continued existence of the ATF is increasingly unwarranted based on their repeated actions to convert law-abiding citizens into felons. They must be stopped. My bill today would abolish the ATF once and for all,” Gaetz said in a statement.

Today, U.S. Congressman Matt Gaetz (FL-01) introduced the “Abolish the ATF Act” of 2023, which eliminates the Bureau of Alcohol, Tobacco, & Firearms (ATF) immediately after the bill’s enactment.

During his time in Congress, Congressman Gaetz has sounded the alarm more than once on ATF overreach. In June and September of 2020, he issued letters to Attorney General William Barr and Acting ATF Director Regina Lombardo calling on the ATF to “cease taking any actions and reconsider or rescind any secret determinations which call into question the legality of firearms owned by millions of law-abiding Americans.” Both letters went unanswered by the ATF. Last week, however, the ATF then cited Rep. Gaetz’s June 2020 letter in their latest announcement of big government overreach by forcing gun owners to face risk of a felony charge if they do not register their firearms with stabilizing braces
