BREAKING: Supreme Court Rules Title 42 Remains in Place Until Court Hears Case

The United States Supreme Court ruled on Tuesday that Title 42 border restrictions can remain in place until the court hears a February case.

The Trump-era deportation policy allows the government to deport illegal aliens crossing the border without permitting them to seek asylum.

19 GOP-led states filed an emergency appeal with the Supreme Court to uphold the policy.

The states include: Arizona, Louisiana, Missouri, Alabama, Alaska, Kansas, Kentucky, Mississippi, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Texas, Tennessee, Utah, Virginia, West Virginia, and Wyoming.

Rep. Jim Jordan (R-OH) tweeted, “We saw record illegal immigration in 2022. If Title 42 ends, it’s going to get even worse in 2023.”

Justices John Roberts, Samuel Alito, Brett Kavanaugh, Amy Coney Barrett and Clarence Thomas voted to uphold the policy in a 5-4 decision.

Neil Gorsuch joined the three liberal justices and voted against the stay request.

“Thank God that Trump won in 2016 and we have the majority on the court. 4 Communists Justices voted in favor of our country being invaded,” Republican Virginia congressional candidate Jarome Bell wrote.

Judge Neil Gorsuch wrote in his dissent:

“Even the federal government acknowledges that the end of the Title 42 orders will likely have disruptive consequences. But the current border crisis is not a COVID crisis. And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort.”

Rep. Lauren Boebert (R-CO) commented on the Biden regime allowing chaos at the U.S. Southern border and ignoring laws to secure the country’s border.

“We shouldn’t have to rely on Title 42 to keep illegals out of our country,” Boebert wrote.

“We have laws on the books that are simply being ignored because the Biden Regime wants chaos at our Southern Border. ALL of the border chaos is deliberate.”

President Trump said Title 42 is “saving what’s left of our country” on Truth Social:

TITLE 42 is saving what’s left of our Country. Ending it, on top of our incredible, but now decimated, STAY IN MEXICO Policy, would greatly speed up the destruction of our Country. Both could have been put into the horrendous Mitch McConnell inspired “gift to the Democrats and China” OMINOUS Bill. What a disaster this Administration, coupled with the almost as bad RINOS, is. JUST CAN’T GET ANY WORSE!

While the Biden administration said it would comply with the Supreme Court order, the Democrat regime is still preparing for when Title 42 ‘eventually lifts.’

White House Press Secretary Karine Jean-Pierre said in a statement:

The Supreme Court’s order today keeps the current Title 42 policy in place while the Court reviews the matter in 2023.  We will, of course, comply with the order and prepare for the Court’s review.

At the same time, we are advancing our preparations to manage the border in a secure, orderly, and humane way when Title 42 eventually lifts and will continue expanding legal pathways for immigration.  Title 42 is a public health measure, not an immigration enforcement measure, and it should not be extended indefinitely.  To truly fix our broken immigration system, we need Congress to pass comprehensive immigration reform measures like the ones President Biden proposed on his first day in office. Today’s order gives Republicans in Congress plenty of time to move past political finger-pointing and join their Democratic colleagues in solving the challenge at our border by passing the comprehensive reform measures and delivering the additional funds for border security that President Biden has requested.
