The Biden administration is facing yet another lawsuit.
Pacific Legal Foundation has filed a lawsuit against Biden for his recent proposal to ‘cancel’ student loan debt—something the organization does not believe he has the authority to do.
According to one of their attorneys, “Congress did not authorize the executive branch to unilaterally cancel student debt.”
This represents the first legal challenge to Biden’s plan, but I doubt it will be the last. I expect an uptick in these types of lawsuits when the GOP retakes control of the government after the 2022 midterms.
Here are just some of the claims the Biden administration is making about their radical plan to cancel student loan debt:
President Biden: “If you earn less than $125,000 a year. You'll get up to $10,000, knocked off your student debt if you earn less than $125,000 a year. And to receive the Pell Grant, you'll get up to an additional 10,000 knocked off that debt.” pic.twitter.com/yzEhyfcYhl

More than 40 million Americans stand to benefit from our student loan debt relief. Nearly 20 million of them could see their debts canceled. About 90% will go to those making under $75,000 a year.
And not a dime will go to those in the top 5% of incomes. Period.

Working people and the middle class will benefit from my Administration's student loan debt relief.
Not those at the top.

Newsmax featured this statement from PLF attorney Caleb Kruckenberg:
“It’s flagrantly illegal for the executive branch to create a … program by press release,” PLF attorney Caleb Kruckenberg said in a statement. “And without statutory authority or even the basic notice and comment procedure for new regulations.”
I recently announced my Administration’s plan to relieve up to $20,000 in student loan debt if you received a Pell Grant and up to $10,000 if you didn’t.
Today, I’m announcing how working- and middle-class folks can apply for that relief.

My commitment if elected president was to make government work and deliver for the people.
Bringing student loan debt relief to folks that need it most as they recover from the pandemic and prepare to restart loan payments keeps that commitment.

President Biden: "I don't want to hear from Republican officials, who had hundreds of thousands of dollars, even millions of dollars in […] PPP loans, but who now attack the working middle-class Americans for getting [student debt] relief." pic.twitter.com/uYWqxTwXKU

Conservative Brief adds:
Biden spoke about the pending lawsuits on Monday, saying he does not believe the Republican-led groups have any standing.
“I will never apologize for helping working Americans and middle-class people as they recover from the pandemic,” Biden said. “Especially not the same Republicans who voted for a $2 trillion tax cut in the last administration.”
