UPDATE: The Good News About The Danchenko Trial

Igor Danchenko’s trial is underway, yet things seem to be going poorly for John Durham…

Today, a judge threw out one of five counts against Danchenko. Judge Anthony Trenga ruled that Danchenko was not lying to the F.B.I. when he told them that he didn’t discuss the contents of the dossier with Charles Dolan…

A closer examination of Judge Trenga’s conclusion shows that it is steeped in technicality and semantics, rather than the honest-to-God truth…

This does nothing for the 4 other counts he is currently facing, as those will still be subject to the deliberation of a jury and that’s the good news.

Many are complaining that John Durham’s investigation has yielded nothing and has fallen flat…

Personally, I am eagerly awaiting his report. If Durham has done anything, it is to show the systematic corruption of the F.B.I. to the public.

Despite this, conservative influencers and pundits were not so convinced that Danchenko’s trial would prove to be fruitful, instead arguing that the jury would ultimately find him innocent…

With today’s ruling that reeks of technicality, I am not so sure I disagree with George:

NTD News provided more insight on the decision to discard one of the charges:

The key word was “talked,” Trenga said, siding with defense lawyers who had argued that a common meaning of talk is to deliver information by speech.

The FBI agents made “no effort” to probe the matter further,” Trenga said.

“Mr. Danchenko answered literally. Mr. Danchenko’s answer was literally true in that the government never established he … talked with Dolan” about the information that was ultimately published in the dossier, which was funded by Democrats including Trump’s rival for president in 2016, former Secretary of State Hillary Clinton.

 

The Associated Press echoed NTD:

As it turns out, there was evidence that Dolan and Danchenko had discussed the information over email.

Defense attorneys argued that Danchenko’s response was literally true because they did not talk orally, and the question the FBI agent asked specifically referenced talking.
