Wisconsin’s Supreme Court Strikes Down Mask Mandate Issued By Democrat Governor

Wisconsin’s Supreme Court stood up to Wisconsin’s Democrat Governor Tony Evers.

In a 4-3 ruling, Wisconsin’s Supreme Court decided that Gov. Evers exceeded his authority by issuing a statewide mask mandate.

The statewide mask mandate by Gov. Evers is now void and residents in Wisconsin are now thrilled that they’re officially set free from wearing masks!

I would give Wisconsin’s Supreme Court praise but in December this same court decided in a 4-3 decision that there was no fraud in the 2020 election.

The Associated Press stayed busy and shared these details:

The Wisconsin Supreme Court struck down Democratic Gov. Tony Evers’ statewide mask mandate on Wednesday, stripping the governor of one of his last remaining tools to curb the spread of the coronavirus as the state stands on the precipice of another surge in infections.

The conservative-leaning court ruled 4-3 that Evers violated state law by unilaterally issuing multiple emergency orders to extend the mandate for months. It found that Evers needed legislative approval to issue more orders after the expiration of the initial 60-day mandate he issued in August.

“The question in this case is not whether the governor acted wisely; it is whether he acted lawfully. We conclude he did not,” Justice Brian Hagedorn wrote for the majority.

The decision marks another legal defeat for Evers. The state Supreme Court in May struck down his stay-at-home order, finding that his health secretary lacked the authority to issue such an order. A state appeals court blocked Evers’ attempts to limit capacity in bars, restaurants and other indoor places in October.

The 4-3 ruling from the conservative-controlled court is the latest legal blow to attempts by Evers to control the coronavirus. It comes after Republicans in the Legislature voted to repeal the mask mandate in February, only to see Evers quickly re-issue it.

The court last May struck down Evers’ “safer at home” order, saying that his health secretary did not have the authority for such an order. Evers’ attempts to limit capacity in bars, restaurants and other indoor places were also blocked by a state appeals court in October.

COVID-19 really exposed how much Democrats are power-hungry.

Thankfully this time Wisconsin’s Supreme Court gave Gov. Evers a slice of humble pie.
