Newly uncovered notes penned by former FBI agent Peter Strzok were obtained this week as part of the Justice Department’s ongoing review of the case against former national security adviser Michael Flynn and turned over to his legal team for review, Fox News has learned.
Fox News obtained a “notice of discovery correspondence” between acting U.S. Attorney Michael Sherwin and the U.S. District Court for the District of Columbia on Tuesday, along with a letter from Sherwin to Powell and Flynn attorney Jesse Binnall.
“As we have previously disclosed, beginning in January 2020, the United States Attorney for the Eastern District of Missouri [EDMO] has been conducting a review of the Michael T. Flynn investigation,” Sherwin and assistant U.S. Attorney Jocelyn Ballantine wrote. “The enclosed document was obtained and analyzed by USA EDMO during the course of its review.”
“This page of notes was taken by former Deputy Assistant Director Peter Strzok,” they continued. “While the page itself is undated; we believe that the notes were taken in early January 2017, possibly between January 3 and January 5.”
They added: “These materials are covered by the Protective Order entered by the Court on February 21, 2018; additional documents may be forthcoming.”

The content and context of Strzok’s handwritten notes are hard to discern, but Flynn’s lawyers called the document “further stunning and exculpatory evidence” that was “previously withheld” from Flynn.
One one line, Strzok wrote, “VP: Logan Act,” which lawyers said suggested that Biden brought up the Logan Act, an obscure law that prohibits private American citizens from negotiating with foreign governments on the U.S.’s behalf. (RELATED: Appeals Court Orders Judge To Dismiss Flynn Case)
Another line quotes a person referred to as “P” — a possible reference to President Obama — saying that he wanted “the right people on it.”
Flynn’s lawyers said that the note shows that “Mr. Obama himself directed that ‘the right people’ investigate General Flynn.”
“According to Strzok’s notes, it appears that Vice President Biden personally raised the idea of the Logan Act. That became an admitted pretext to investigate General Flynn,” the attorneys wrote in the filing.

Flynn’s attorneys filed the document just as a federal appeals court ordered Judge Emmet Sullivan to dismiss charges against Flynn. The Justice Department filed a motion on May 7 to drop the case against Flynn, but Sullivan was seeking to force prosecutors to explain the decision in a series of hearings.
Biden has acknowledged that he was aware of an ongoing investigation into Flynn before he left office, but he has downplayed his involvement in the probe.
“I was aware that they asked for an investigation, but that’s all I know about it,” Biden told ABC’s George Stephanopoulos in a May 12 interview.

The handwritten notes from fired former FBI agent Peter Strzok appear to describe a Jan. 5, 2017, Oval Office meeting between Obama, Vice President Joe Biden, Comey, Yates, and then-national security adviser Susan Rice. The meeting and its substance were confirmed in a bizarre Inauguration Day email Rice wrote to herself.
It was at this meeting, which was confirmed by testimony from Comey and Yates, that Obama gave guidance to key officials who would be tasked with protecting his administration’s utilization of secretly funded Clinton campaign research, which alleged Trump was involved in a treasonous plot to collude with Russia, from being discovered or stopped by the incoming administration.
Yates told the special counsel that Obama broke the news of Flynn’s phone calls with Russian Ambassador Sergey Kislyak to her during the Jan. 5 meeting. Yates detailed further involvement from Obama. “President Obama said he wants to be sure that, as we engage with the incoming team, we are mindful to ascertain if there is any reason that we cannot share information fully as it relates to Russia,” she wrote in her email.
The new notes, which record Comey’s accounting to Strzok of the meeting’s substance, constitute definitive evidence that Obama himself was personally directing significant aspects of a criminal investigation into his political enemy’s top foreign policy adviser.
