Appeals Court Agrees With DOJ, Drop Case Against General Flynn!

The D.C. Circuit Court of Appeals has ruled against the judge in Michael Flynn's case, who hasn't dropped charges, despite DOJ directive to do so.

The case against disgraced general, Michael Flynn, may just be the first domino to fall. 

Flynn had pled guilty to lying to the FBI, but a few weeks ago, The Justice Department asked prosecutors to drop the case. 

Why? Because it turns out they were likely investigating him without any justification in the first place! 

But justice may finally be served for President Trump's former NSA advisor:

In a surprise ruling, the D.C. Circuit Court of Appeals on Wednesday overruled District Judge Emmet Sullivan and ordered him to accept the Justice Department's motion to dismiss the case against former national security adviser Michael Flynn.

President Donald Trump reacted within minutes, tweeting that the ruling in favor of his first national security adviser, whom the president has repeatedly claimed was investigated and prosecuted unfairly, was "Great!"

Special counsel Robert Mueller charged Flynn with one count of lying to federal investigators in late 2017 – a charge to which Flynn twice pleaded guilty. Critics allege his case is an example of alleged politicization of the Justice Department under Trump and Attorney General William Barr."

Controversy had continured to plague the case once the DOJ recommended to drop the charges against Flynn. 

Despite being directed by the government to let the case go, Judge Emmet Sullivan decided to take matters into his own hands. 

As reported by our friends at Fox News:

This was the result of an appeal from Flynn's lawyers asking for a so-called writ of mandamus -- essentially an order telling a government official to carry out a certain duty -- directing Judge Emmet Sullivan to approve the DOJ's motion to dismiss.

Sullivan did not immediately grant that motion and instead sought to hold hearings on the matter, angering Flynn allies.

The unusual move from Sullivan to keep the case alive despite prosecutors' wishes was preceded by an unusual move from the DOJ itself to drop the charges against Flynn even after he had pleaded guilty -- saying the FBI interview that led to his charge of lying to investigators about his contacts with Russia's ambassador had no "legitimate investigative basis."

It's unclear whether Sullivan could try to appeal to the full appeals court or even to the Supreme Court in order to keep the case alive. The next step otherwise would likely be for Sullivan to comply.

The ruling by the appeals court is a major victory for Flynn and attorney Sidney Powell, and a defeat for Special Counsel Robert Mueller, former FBI Director James Comes, and “deep state” partisans who had sought to convict Flynn in their pursuit of false allegations of “Russian collusion” against President Donald Trump and his 2016 presidential campaign.

Flynn had pleaded guilty of lying to the FBI in 2017, though the FBI itself believed he had not done so. He was allegedly pressured to offer a guilty plea. The FBI was forced to reveal exculpatory evidence after Attorney General William Barr assigned U.S. Attorney Jeffrey Jensen to review irregularities in the case earlier this year.

The saga of General Flynn's case may not quite be over, just yet.

Which way will Judge Sullivan go? 

Will he respect the decision which outlines his Constitutional limitations against the Federal Governments prerogative to drop the case if evidence allows it?

Or will he continue the trend of activists judges who undermine the Trump administration at every turn?

This may just be the beginning of the end for the conspiracy against Trump and his administration.
